My child has special needs – what can I do to provide for him after my death?

A “pooled trust” is one option if you want to provide assistance for your beneficiaries. This trust pools the resources of multiple beneficiaries which are then managed by a non-profit organization. A benefit of this trust is that it can be used for beneficiaries of any age as opposed to individual disability trusts which can only be created for persons under 65 years. In the event of the beneficiary’s death, the state does not have to be repaid for the Medicaid expenses as the funds in the trust are retained for the other beneficiaries with special needs who pooled their resources in order to create the trust. The pool is most created through multiple beneficiaries who have limited resources alone; the accounts remain separate but pooled together to maximize resources for the non-profit organization to invest.
